I appreciate the information.

However, I do not feel that you addressed an of our concerns. It seems to us that the
Attorney Generafs office should be protecting our Constitutional rights as provided by the
TABOR Amendment. It appears that Section 37-92-103 of the Colorado Revised
.. Statutes which authorizes districts to create water activity enterprises was enacted for the
express purpose of circumventing the rights granted under the TABOR Amendment.

Why is the Attorney Generafs office not defending our Constitutional rights under the
TABOR Amendment to have the right to vote? Instead, it appears that your office has
entered the case as a defendant instead ofa plaintiffin Supreme Court Case No. 97SA303.
There are a lot of people who are disturbed that entities such as Ute Water Conservancy
District can create water activity enterprises and deprive them of their right to have a
voice in matters that financiany obligate them.

How is the Supreme Court of~i.7 state of Colorado going to be aware of our concerns?
Is it correct that we aSSUDl.e that it is the reponsibility of the Attorney Generafs office to
defend our Constitutional Rights such as those accorded us by the T ADOR Amendment?

!s their any oth~ action that we can take to have our concerns addressed by your office or -
the Supreme Court ofth~ State of Colorado?

;Zel~O~~

John 1.
