<br />3. Question. Why does Morrison need raw water storage <br />facilities? <br /> <br /> <br />Answer. cooley has proposed a guarantee of $25,000 per year <br />in sales taxes. We are of the opinion that this will be more <br />than adequate to address any direct governmental costs to the <br />Town arising out of the Cooley operation. Additionally, the <br />annexation will allow the Town the ability to exercise a greater <br />influence on land use and development south of Morrison. <br />Finally, it will allow Morrison to exercise control over an <br />industrial property impacting the Town. <br /> <br />Answer. Morrison's water rights would allow storage of <br />substantial quantities of raw water if adequate storage <br />facilities existed. <br /> <br />The Town's engineers, in numerous studies over the years, have <br />recommended that the Town develop raw water storage. In 1982 the <br />Town completed a 29 acre foot reservoir (at a cost of nearly a <br />half million dollars) which will provide approximately 30 days of <br />water in the event of an interruption of supply on Bear Creek due <br />to drought, quality problems or failure of a component of the <br />supply system, such as the diversion structure or transmission <br />line; however, this is insufficient to meet the Town's long term <br />needs nor does it allow for any development. <br /> <br />Morrison currently lets hundreds of thousands of gallons of water <br />which it owns, a valuable commodity, simply flow down the stream <br />unused because we have no place to put it. There is a risk that <br />non-use of this water over a long period of time, with no plan to <br />capture it in the future, might lead a water court at some point <br />to conclude we have abandoned the right to use it. <br /> <br />The Town currently lacks an adequate supply of raw water to <br />provide for development of the commercial areas east of Town. <br />Even a small scale development in this area would significantly <br />improve Morrison's tax base and its ability to meet future <br />challenges while remaining independent. <br />(Feasibility Analysis, 9/30/94) <br /> <br />4. Question. What obligation does Morrison have to <br />construct either reservoir? <br /> <br />Answer. Morrison is under no obligation to construct either <br />reservoir. With respect to the first reservoir, the Town must <br />advise Cooley on or before July 1, 1998 whether it will proceed <br />with the reservoir. (Annexation Agreement-Paragraph 6.1) <br /> <br />5.
