Box 148
Fort Lupton, CO 80621

Re: Construction Fund Loan Authorization

Dear Mr. Funderburk:

In 1994, the Colorado Water Conservation Board (CWCB) approved a loan of $354,000 to the
City of Fort Lupton for the construction of two new wells. The loan was subsequently authorized
by the legislature in House Bill 95-1155. A copy of our letter to the City regarding the Board's
loan approval is enclosed.

It was our understanding in June 1995, based on a conversation with the City's engineering
consultant, that the City had decided not to construct the wells in that year. We have had no
further communication regarding the project in the last three years.

We are therefore writing to inquire whether the City is still intending to pursue the project. Ifnot,
we would like to be able to deauthorize the $354,000 loan in order to make these funds available
to other water users in Colorado who would like to avail themselves of the Construction Fund
loan program. In the event you are not intending to construct the wells, a letter from the City to
that effect would be very much appreciated.

Please call me if you have any questions. Thank you.

Sincerely

~~

William E.
