Russell Anson, Esq. <br />820 13th Street <br />Greeley, Colorado 80631 <br /> <br />RE: Colorado Water Conservation Board Loan Contract With the <br />Town of Johnstown and the Town of Johnstown Water Activity <br />Enterprise <br /> <br />Dear Mr. Anson: <br /> <br />As we discussed yesterday, enclosed for your review are four <br />pages from the above-described loan contract that have been <br />revised to address the use of a cash reserve account rather than <br />a CD as collateral for the loan. Please let me know if the <br />revised language is acceptable, and the CWCB will send out <br />originals of the contract to the Town for signature. Also, <br />please send the signed attorney opinion letter to the CWCB after <br />your review of the contract. <br /> <br />please note that the Town still needs to provide the CWCB <br />with a copy of the ordinance adopted by the water enterprise on <br />August 5, 1996, and a parity certificate from an independent <br />C.P.A. as provided in Exhibit F to the February 1, 1996 Loan <br />Agreement between the Colorado Water Resources and Power <br />Development Authority and the Town/Enterprise. Additionally, <br />before the loan contract can be executed by the CWCB, the Town <br />must submit its feasibility report to Bill Green at the CWCB. <br />
