Mr. Kim la'wrence
May 29, 2001
Page 2

exchanged, 4) excess recharge accretions from the lower South Platte
Recharge Project on the Peterson Ditch, decreed in Case No. 90CW182,
5) excess recharge accretions from the lower South Platte Recharge
Project on the Liddle Ditch, decreed in Case No. 97CW108, and 6)
excess recharge from new sites along the Peterson ditch.

3. Use of the lSPWAE Well No.2 will be accounted for by modifying the
existing accounting performed by the District in connection with the
existing substitute water supply plan. The diversions from the well will be
recorded by a meter and monthly diversions will be routed using the SDF
method to determine the amount and timing of depletions at the South
Platte River.

4. Jon Altenhofen and Jim Hall (of the Division 1 office) confirm there are no
other wells within 600 feet of the subject well. The maximum pumping
rate of the new well shall be limited to 3000 gallons per minute and the
annual amount to be withdrawn shall be limited to 4000 acre-feet.

Pursuant to Section 37-80-120, C.R.S. (2000), the amendment to the
current substitute water supply plan is hereby approved. All of the conditions
contained within the approval letter dated April 27, 2001 shall apply, with the
exemption of approval condition number 1 and 2. Condition NO.2 is amended to
allow the sale or lease of credits to GASP for replacement of well depletions for
their members. In addition, we stress that measurement and accounting of
replacement water from the Beaver Well and the LSPAWAE Well No.2 must be
approved by the Division Engineer or his Designee. The pumping limitations shall
be those listed above in paragraph number 4 above.

Should you have any questions or comments, please contact Bill Mcintyre
of this office, or Jim Hall, Assistant Division Engineer, in Greeley at 970-352-
8712.

Sincerely,

-Ik tJ ..I~
Hal D.
