Division 1, W.District 64 <br /> <br />Dear Mr. Lawrence: <br /> <br />We have reviewed your May 25,2001 letter request for an amendmentto <br />the current Substitute Water Supply Plan for the Lower South Platte Water <br />Conservancy District (District) approved by this office by letter dated April 27, <br />2001. This amendment is to allow the additional source of replacement water <br />from a new well, referred to as LSPWAE Well NO.2. This well will be located in <br />the NW1/4 of the SE1/4, Section 20, Township 12 North, Range 44 West of the <br />6th P.M., Sedgwick County, Colorado. The owner of the property, Farmers Grain <br />Co. of Julesburg (James G. Kontny) has verbally indicated its assent to use the <br />property. <br /> <br />The following terms and conditions apply to this amendment. <br /> <br />1. The location of the subject well has a corresponding SDF (stream <br />depletion factor) of about 760 days. Therefore, pumping of this well will <br />not have an immediate depletive impact to the South Platte River. <br />Pumping of the well and delivery of the water through the State Canal <br />Ditch will allow immediate replacement of out-of-priority well depletions. <br /> <br />2. If pumping of LSPWAE Well NO.2 is required, there mayor may not be <br />depletions impacting the South Platte River during a time of call. Lower <br />has several replacement sources availabletoremedy injury. They include <br />1) recharge accretions purchased from Farmers Grain Co. which are <br />available from two existing recharge ponds on the property adjacent to the <br />proposed well, 2) future pumping of LSPWAE Well No.2, 3) recharge <br />accretions purchased from the Tamarack Recharge project that can be <br />
