<br />incorporated city or town in the District; 27 owners of <br /> <br />non-irrigated lands in the District which are not embraced <br /> <br />within the limits of an incorporated city or town in the <br />District, approximately one per cent (1%) of all owners of <br />non-irrigated lands in the District which are not embraced <br />within the limits of an incorporated city or town in the <br />District, signed the petition to form the District. Each <br />such owner listed the tract he owns opposite his name and <br /> <br />each tract so listed has an assessed valuation, together <br /> <br />with improvements, of not less than One Thousand Dollars <br />($1,000.). <br />20. On application being made by petitioners, <br />paragraph 6 of the Petition is amended to conform to the <br />proof as follows: "6. The assessed value of all irrigated <br />land together with improvements thereon within the <br />boundaries of the District is $13,797,011." <br />21. There are no cities within the proposed District <br />with a population of more than 25,000. The City of Sterling, <br />by and through the written consent of the Chief Executive <br />Officer of that city, and with the approval of the legislative <br />body of that city, has consented to inclusion within the <br />District without restriction as to the minimum rate of <br />taxation. The towns of Julesburg, Ovid and Sedgwick filed <br />an objection to the District prior to the date on which this <br />Court declared the District organized. Julesburg, Ovid and <br />Sedgwick did not otherwise appear. <br />22. This Court has jurisdiction over the parties to, <br />and the subject matter of, this proceeding. <br /> <br />-8- <br />
