<br />Mr. l-eroy Cruz <br />March 28, 2001 <br />Page 2 <br /> <br />We have considered splitting the Enterprise in two, but that could risk a violation <br />of the Colorado Constitution and would undoubtedly take quite a bit of time. <br /> <br />The Mayor, Jim Watson, in a conference call among you, me, the Mayor, Bill Green <br />of CWCB, and Linda Bassi of the Colorado Attorney General's Office today, March 28, <br />2001, authorized this request. <br /> <br />Please advise whether Rural Development is willing to either release the pledge of <br />a first lien on the water system revenues, or whether Rural Development will grant parity <br />to Colorado Water Conservation Board. <br /> <br />I enclose a copy of page 28 of the 1994 Ordinance No. 349, which indicates that <br />parity should be available, as set forth. <br /> <br />Thank you for your assistance. Victor has the plans for the dam rehabilitation under <br />review by the Dam Safety Engineer of the Colorado State Engineer's Office now and, if the <br />plans are approved, Victor hopes to be able to do the work after the snow melts and the <br />mud dries. Victor Reservoir No. 2 is at an elevation of about 10,400 feet, so the City <br />hopes work might begin at the end of May.
