<br />r <br /> <br />b. Supervising engineer shall have full authority to make decisions as to the <br /> <br /> <br />scope and nature of the work being performed. <br /> <br /> <br />c. Decisions of supervising engineer shall be accepted by both PMRCA and RMI <br /> <br /> <br />as being fmal and nonappealable. <br /> <br /> <br />d. Supervising engineer will determine when all work has been completed in a <br /> <br /> <br />satisfactory manner and issue his certificate of completion. <br /> <br /> <br />e. The fees and expenses of the supervising engineer shall be paid jointly by <br /> <br />RMI and PMRCA. <br /> <br /> <br />f. Jointly dismiss all claims and counterclaims in this action and each shall be <br /> <br /> <br />responsible for its own costs, fees, and attorney fees. <br /> <br /> <br />g. Execute such documents, instruments, or other writings as may be reasonably <br /> <br /> <br />necessary for the other party hereto to complete its performance under this <br />bagreement. <br />
