The Office of the State Engineer has required the owner, <br />DeWeese-Dye Ditch and Reservoir Co., to retain a qualified <br />engineering consultant to prepare plans and specifications for <br />rehabilitation of the dam by no later than July I, 1997 and to have <br />the repairs completed by July I, 1999. <br /> <br />3. Failure to meet these required suspense dates could result in <br />reservoir storage restrictions being imposed by the State Engineer. <br /> <br />4. Stability analyses by GEl Consultants, Inc. indicates a less <br />than acceptable factor of safety for six different possible loading <br />conditions and, in fact, predicts possible dam failure for three of <br />the loading conditions. <br /> <br />5. Failure of the top 12 ft. of the dam and the resulting flood <br />wave is expected to cause significant downstream damage to the <br />Temple Canyon Bridge and those residences located in the flood <br />plain downstream of the confluence of Grape Creek and the Arkansas <br />River. <br /> <br />6. DeWeese-Dye Ditch and Reservoir Co. is legally liable for all <br />damages resulting from a dam failure. <br />
