<br />The Court further finds that upon proof being made <br /> <br /> <br />said petitioners were awarded Priority No. 27 in Irrigation <br /> <br /> <br />District No. 64 of Irrigation Division No. 1 of the State <br /> <br /> <br />of Colorado, under the name and style of The Farmers DitQb, <br /> <br /> <br />as prayed for in said petition. <br /> <br /> <br />The Court further finds that thereafter and on or <br /> <br /> <br />about the 13th day of February, A. D. 1904, the said petitioners <br /> <br /> <br />hereinbefore referred to, filed or caused to be filed with <br /> <br /> <br />tho Secretary of State of the State of Colorado Articles of <br /> <br /> <br />Incorporation by which Articles they sought to incorporate <br /> <br /> <br />said The Farmers Ditch and the water rights owned thereby <br /> <br /> <br />as a mutual ditch company under the name and style of The <br /> <br /> <br />Farmers Ditch Company 7 that for reasons unknown the name of <br /> <br /> <br />the company as set forth in said proposed Articles of Incorpora- <br /> <br /> <br />tion was thereafter changed by interlineation to read The <br /> <br /> <br />People's Ditch CompanY1 that on March 4, A. D. 1904, th. <br /> <br /> <br />Secretary of State of the State of Colorado issued a Certifi- <br /> <br /> <br />cate of Incorporation to The Peopl.-s Ditch Company. <br /> <br /> <br />The Court further finds from an examination of certified <br /> <br /> <br />copy of the Articles of Incorporation that the same five individ- <br /> <br /> <br />uals Who filed the petition in this case and obtained Priority <br /> <br /> <br />No. 27 as hereinbefore set forth are the same five individuals <br /> <br /> <br />who filed Articles of Incorporation for The people's Ditch <br /> <br /> <br />Company; that the headgate, ditch and water rights described <br /> <br /> <br />in the Articles of Incorporation is one and the same as the <br /> <br /> <br />headgate, ditch and water rights described in petitioners- <br />
