<br />I have conducted a survey of the property and immediate vicinity for montane <br />amphibians including adults, egg masse~ larvae and .IJVItiIlg calls, and Cound no evidence of any <br />amphibians at the proposed location. In the immediate vicinity of the property (within 1 mile) <br />only western chorus frogs (Pseudacru triseriato) were detected. No sign ofborael toads (Bulo <br />boreas bo1YUlS) was detected at the proposed pond location or within 1 mile oCthe property. A <br />survey of the vegetation in the proposed site and found no Ute ladies tress (Spiranthes diluviaJi-s) <br />on the site to be excavated, or elsewhere on the property. In addition, I have contacted Dr. <br />David Armstrong at Colorado University (specialist on mice and voles) and Bruce Rosenlund at <br />the US Fish and Wildlife Service concerning the possibility of the presence of tile prebles <br />meadow jumping mouse (Zoppw hudsonius preblei). Both oftbese individuals are coofident <br />that the proposed pond location is outside the habitat of this endangered mammal, and would <br />therefore have no negative impact. <br /> <br />It is my understanding that the proposed pond fully qualifies Cor the agricultural <br />exemption for stock watering pmposes in section 404(t) 33 C.F.R.
