In late December, Staff began receiving letters from numerous entities and individuals both opposing and supporting the proposed recommendations. Numerous issues have been raised in these letters with regard to these proposed instream flow recommendations. In addition, the BLM has provided a letter requesting an additional year to evaluate the issues identified in the letters. now has also provided a letter which also recommends a delay in order to provide time to develop a reasonable and equitable solution to the issues. (See previous attachments provided in the Bo~d Notebooks as well as additional attachments recently received by staff). Furthennore, Staff has just reviewed the attached confidential memorandum from Assistant Attorney General Paul Benington to the Colorado Water Conservation Board regarding an evaluation of settlement language. Staff Recommendation As a result of the numerous issues raised by those both supporting and opposing the recommendations; the request by the BLM and DOW for a one year delay; and the complexity of the issues involved in the analysis of settlement language by the Attorney General's office, staff recommends that the Board table the recommendations for a period of one year. Staff further recommends that the Board direct staff to continue to try and negotiate with Jackson County with the intent of providing settlement language which will ensure that any ISF appropriations on the subject streams will not deprive the water users of the North Platte River and its tributaries of the water guaranteed to them by the Nebraska v.
