<br />_/ <br /> <br />~ <br /> <br />-2- <br /> <br />"\ <br /> <br />recommendations were noticed on the JanuarY 23-24, Board meeting agenda and the executive summary <br />reports and supporting documentation was posted on the web and provided to the Board. . <br /> <br />In late December, Staff began receiving letters from numerous entities and individuals both opposing and <br />supporting the proposed recommendations. Numerous issues have been raised in these letters with regard to <br />these proposed instream flow recommendations. In addition, the BLM has provided a letter requesting an <br />additional year to evaluate the issues identified in the letters. now has also provided a letter which also <br />recommends a delay in order to provide time to develop a reasonable and equitable solution to the issues. <br />(See previous attachments provided in the Bo~d Notebooks as well as additional attachments recently <br />received by staff). Furthennore, Staff has just reviewed the attached confidential memorandum from <br />Assistant Attorney General Paul Benington to the Colorado Water Conservation Board regarding an <br />evaluation of settlement language. <br /> <br />Staff Recommendation <br /> <br />As a result of the numerous issues raised by those both supporting and opposing the <br />recommendations; the request by the BLM and DOW for a one year delay; and the complexity of the <br />issues involved in the analysis of settlement language by the Attorney General's office, staff <br />recommends that the Board table the recommendations for a period of one year. Staff further <br />recommends that the Board direct staff to continue to try and negotiate with Jackson County with the <br />intent of providing settlement language which will ensure that any ISF appropriations on the subject <br />streams will not deprive the water users of the North Platte River and its tributaries of the water <br />guaranteed to them by the Nebraska v.
