CO 80203 <br /> <br />IIDrDrarfo Water Consetvation So'h- <br />r4.1. <br /> <br />Re: Proposed Inslream Flows in Jackson County <br /> <br />Dear Rod: <br /> <br />I am writing in opposition to three instream flow filings proposed by the Colorado <br />Water Conservation Board (CWCR) in Jack.<IDn County. I understand the Jackson <br />County Commissioners, the Jackson County Water Conservancy District (the District), <br />the North Park Stockgrowers and many local landowners oppose these filings. <br /> <br />. <br /> <br />The filings are not based on stream gauge records and cross many private <br />landowners. Unlik.epast instream flow appropriations, these are located below existing <br />diversions such that injury is more likely to occur. In addition, one of the instream flow <br />appropriations terminates at the Colorado and Wyoming ~1ate line. The proposed filings <br />could run afoul of the U.S. Supreme Court equitable apportionment decree that governs <br />water use in Jackson County. <br /> <br />I respectfully request CWCB to drop these proposed appropriations from <br />consideration and to work with the District and affected land and water right holders in <br />Jackson County to protect their ability to rely upon waters apportioned by the U.S. <br />Supreme Court.
