What about the consumptive domestic decree from Beale Springs that
removes water from Smith Fork Creek within the proposed section below the
gauging station.

6. What about the consumptive domestic decree for the Smith Fork Guest Ranch
that removes water from Smith Fork Creek within the proposed section below
the gauging station.

7. Was the Barnard Ditch consumptive decree removing water from ~ Creek
(Smith Fork), again below the gauging station, with return flow into the
Needle Rock Ditch thus again never going back into the Smith Fork,
considered?

8. The CWCB did not consider the Saddle Mountain Highline consumptive
diversion which occurs below the North and South Smith Fork junction.
There is a considerable amount of water taken there. I do not know the
historical data on this ditch but Mr. John Cunningham of Crawford can assist
. you with that.

In summery ;fjust can not believe1heCWCB condUcted an accurare-survey for the
possible "inStream flow" right for this section of the Smith Fork:. This matter should be
tabled until accurate data can be compiled.

I hope this information is of value to assist in your decision regarding this matter.

Sincerely.

Larry M.
