I received the attached email from Jeff Comstock, Director of the Moffat County Natural Resources Department,
regarding the pending proposals for new instream flow appropriations on Little Cottonwood Creek and Willow
Creek in Moffat County, both of which are on the agenda for November's CWCB board meeting. I would
appreciate if you would supply this email, in hard copy, to all of the CWCB board members and appropriate staff
members and representatives of DOW and BLM, as part of the packet of information regarding such proposals.

1. Moffat County understands CWCB staff are requesting an instream flow determination for Little Cottonwood
Creek in Moffat County be postponed one year for more data collection.
Moffat County and Land Use Board Member Dave Watson told the board it would be dry. It was. CWCB staff
and Moffat County LUB members jointly monitored Little Cottonwood at least 3 or 4 times this year. It doesn't
have runoff available for an instream flow because it is relatively dry most of the summer. We had tremendously
large rains this year that helped keep a trickle in Little Cottonwood and it still won't sustain an instream flow.
Moffat County requests the CWCB not allow it to be postponed another year and deny the in stream flow proposal.

2. Moffat County also understands that CWCB staff are bringing Willow Creek to you for instream flow
considerations. Staff are using a September 5, 2003 data gathering trip as evidence for the proposed
f1ow_ CWCB and BLM staff are bringing this proposal forward to the Board without working with Moffat
County nor its citizens to recommend this proposal. Moffat County requested at the last board meeting
that before future proposals located in Moffat County were to be presented to the Board, that Moffat
County would be involved in the assessment. The board agreed, yet no coordination took place for the
