Security for the loan will <br />be a pledge of Logan Irrigation District annual assessment levy revenues, in <br />compliance with CWCB Financial Policy No.5. As per the original loan <br />authorization, Staff further recommends that final approval of the loan be <br />conditioned upon the following: 1) a special agreement among the three parties shall <br />be executed that addresses specific loan responsibilities ofthe parties; and <br />recognizes CWCB as a Third-Party Beneficiary; and 2) the authority to assume the <br />proposed indebtedness shall be approved by the Logan Irrigation District electors in <br />accordance with the applicable provisions of the Irrigation District Law of 1905, <br />C.R.S. 37 -41-113(4) and c.R.S. 37-41-117, or as amended, at the time of contract <br />execution. The motion was approved unanimously (9-0). <br /> <br />. <br /> <br />Tape 1, Track 2 01:35:30-01:36:37 <br />Action: A motion was made by Carl Trick and seconded by Harold Miske1 to make the <br />final determinations on the above-mentioned Armstrong and Elkhead Creek <br />stream reaches in Water Division 6, which were previously approved by the <br />Board, when it declared its intent to appropriate in January 2006, and reaffirmed <br />in September 2006, to find that: 1) there is a natural environment that can be <br />preserved to a reasonable degree by the CWCB's water right, if granted by the <br />Water Court; 2) the natural environment will be preserved to a reasonable degree <br />by the water available for the appropriation to be made; and 3) that such <br />environment can exist without material injury to water rights.
