<br />.' <br /> <br />. <br /> <br />Colorado Water Conservation Board <br />Concerning the Application for Water Rights <br />of the Town of Avon <br />in Eagle County, Colorado <br /> Case Number: <br /> 05CW258 <br />NOTICE OF PREHEARING CONFERENCE <br />AND DEADLINES FOR SUBMISSIONS <br /> <br />Pursuant to Rule 12 of the Rules Concerning Recreational In-Channel Diversions ("RICD <br />Rules"), the City of Avon has requested a hearing on its RICD application. The Colorado <br />Water Conservation Board ("Board") has designated Casey Shpall as the Hearing Officer <br />for this proceeding, and set the hearing date for its November 13-15, 2006, meeting at <br />the Red Lion Hotel, 4040 Quebec Street, Denver, Colorado. The exact time ofthe <br />hearing will be determined at the Board's meeting on September 19-20 at the Evergreen <br />Lodge in Vail, Colorado. In addition, the Board may take public comment on this matter <br />. during the September meeting to facilitate local input. <br /> <br />Pursuant to RICD Rule 13, the Hearing Officer hereby establishes the following <br />deadlines for written submissions, designation of witnesses and exhibits, and the date of <br />the preheating conference. Twenty-two hard copies of each document must be received <br />by the Board before 4:45 p.m. on the day that they are due. A copy of each document <br />must also be received, by hard copy or email, by the Board's Staff, the Hearing Officer, <br />the Assistant Attorney General representing the Staff and the Parties before 4:45 p.m. on <br />the day that they are due. Your materials will be provided to the Board in advance of the <br />hearing. Comprehensive summaries of the testimony are recommended to familiarize the <br />Board with your issues in advance of the hearing. <br /> <br />. <br /> <br />Pursuant to RICD Rule 13.d, the Prehearing Statements shall include: (1) a list of all <br />disputed factual and legal issues; (2) the position of the Party regarding the legal and <br />factual issues; (3) a list identifying all of the witnesses that will testify for the Party, and a <br />summary of the testimony that those witnesses will provide; and, (4) copies of all exhibits <br />that the Party will introduce at the hearing. Staffs Prehearing Statement may also <br />include a recommendation for action by the Board. <br /> <br />September 22, 2006: Applicant's Prehearing Statement is due. <br /> <br />October 6, 2006: Prehearing Statements of all other Parties, including Staff, are due. <br />
