Water Supply Protection Section - Durango RICD <br />Tape 2, Track 3 01:42:21-01:44:12 <br />Action: A motion was made by Travis Smith and seconded by Keith Catlin to approve <br />Staffs recommendation that the Board: 1) set the RICD hearing for Monday July <br />24, at 10:00 am, in conjunction with the Board's currently scheduled meeting in <br />Durango; 2) authorize the Staff and the Attorney General's Office to participate <br />in settlement discussions with the Applicant and the other objectors; and 3) <br />appoint Casey Shpall, or her designee, as a hearing coordinator to coordinate the <br />schedule associated with a hearing, to the extent necessary, so that the Board can <br />meet the July 28,2006 deadline for issuing findings of fact and <br />recommendations. Russell George was not present for the vote. The motion was <br />approved unanimously (9-0). <br /> <br />26. Stream and Lake Protection Section - Arkansas River Instream Flow Appropriation <br />Tape 2, Track 4 00:00:00 - 01:30:40 <br />Action: A motion was made by Barbara Biggs and seconded by Russell George to <br />declare the Board's intent to appropriate an instream flow water right, per Rule <br />5d of the Instream Flow Rules, on the recommended instream flows on the <br />segment of the Arkansas River in the vicinity of the City of Pueblo between the <br />outlet of Pueblo Reservoir and the Arkansas River - Fountain Creek confluence, <br />and to approve Staffs recommendations that the Board: 1) consider information <br />and history provided on the stream reaches, the analysis and studies from the <br />DOW, as well as the information provided on water availability; 2) declare its <br />intent to appropriate an in stream flow water right on the Arkansas River as <br />described to the Board; and 3) adopt the modified hearing schedule below to <br />allow this appropriation in May, as opposed to January. Carl Trick, Eric <br />Wilkinson, and Tom Sharp voted against the motion.
