<br />bi ddi ng and di rect the pu rchas i ng agent to purchase necessary <br />supplies in the open market. <br />Section 7.3 - Contracts: <br /> (a) All contracts and leases to which the city is a party <br />when this charter becomes effective shall remain in full force <br />and effect for the life of the contract or lease. <br /> (b) The authori ty to cont ract on behalf of the ci ty is <br />vested with the City Manager and shall be exercised in accor- <br />dance with the provlsions of Statute and of this charter, pro- <br />vided that any contracts in excess of the city Manager's <br />spending authority as provided by this charter or by the Munici- <br />pal code must be approved by the City council. <br /> (c) A(i contract or agreement in an amount in excess of <br />the amount ixed by ordinance made with form or terms other than <br />the standard city purchase order form, shall, before execution, <br />be submitted to the attorney and his opinion obtained with re- <br />spect to its form and 1 ega 1 i ty. A co~~ of all contracts or <br />a~reements requiring such an opinion sha be filed with the of- <br />flce of the city clerk, together with a copy of the opinion. <br /> (d) Before any contract, agreement or pu rchase order is <br />entered into which obligates the city to pay an amount in excess <br />of the dollar value established by ordinance, the accountin~ of- <br />ficer of the City or the City Manager shall first have certlfied <br />that an appropriation has been made for the payment thereof, or <br />that sufficient funds will be available if it be for a purpose <br />bei ng fi nanced by the issuance of bonds or by speci a 1 assess- <br />ments or for some other purpose not chargeable to a bud~et ap- <br />propriation. In the case of a contract or agreement obllgating <br />the City for periodic payments in future fiscal years for the <br />furnishlng of a continuing service or the leasing of propertb, <br />such certi fi cati on need not cover those payments whi ch wlll e <br />due in future fiscal years, but this exception shall not apply <br />to a contract for the purchase of construction of, a public im- <br />brovement unless such purchase or construction is being financed <br />y an installment contract. Certification by the accounting of- <br />ficer of the City or by the City Manager shall be endorsed on <br />each contract, agreement or purchase order requi ri ng same or <br />shall be filed as an attachment thereto. <br /> (e) No contract or purchase order shall be subdivided for <br />the dU rpose of ci rcumventi ng the dollar value limitations im- <br />pose by ordinance. <br /> (f) NO contract shall be amended after the same has been <br />made except upon the authority of the council, provided that the <br />ci ty Manager may amend contracts for those pu rchases and sales <br />made by hi m when the doll ar value is 1 ess than the 1 i mi tati on <br />imposed by ordinance. <br /> (g) No compensation shall be paid to any contractor except <br />in accordance with the terms of the contract. <br />
