Box 581 <br />Brush, CO 80723 <br /> <br />Dan McAuliffe <br />Deputy Director <br /> <br />RE: <br /> <br />Diversion Rehabilitation <br />Emergency Loan Approval <br /> <br />Dear,Mr, Mortensen, <br /> <br />I am pleased to inform you that the Colorado Water Conservation Board (CWCB) approved your <br />Emergency Loan request on March 21, 2002, The loan is for rehabilitation of your diversion <br />structure on the South Piatte River, near Fort Morgan, <br /> <br />The Board approved an Emergency Loan from the Construction Fund in a maximum amount of <br />$83,000, The loan terms are 2,25% for 10 years, The Board also approved a grant in amount of <br />$2,500 to pay for up to half the cost of the feasibility study, I have attached a copy of the updated <br />Board memo concerning the Upper Plate and Beaver Canal Company. Please refer to page 4 of <br />that memo and to the section "Action taken by the CWCB March 21, 2002." <br /> <br />When the Board approved this Emergency loan it attached several conditions: <br /> <br />1. A Feasibilitv Study is required, We understand that Jack Odor, P.E" has drafted the study, <br />which is scheduled for completion in April 2002. The study must be completed and meet the <br />requirements of the CWCB Construction Fund Guidelines for feasibility studies, <br /> <br />2. An approved contract must be in place before funds can be advanced. Jan IlIian has placed <br />this project on our contracting "hot list" and has initiated the loan contracting process. Our goal <br />is to have this loan contract ready for final signature as soon as possible, <br />
