".

Central Colorado WCD
November 25-26, 2002

Agenda Item 20e.
(Updated December 4,2002)

expanded the use of their water right. The Moyers filed a counter-suit arguing that the
Colorado State Engineer had allowed Empire Lodge to fill its upstream lake illegally
under a substitute supply plan approved by the State Engineer,

The case was ultimately heard by the Colorado Supreme Court, and at the end of last
year, it ruled the State Engineer did not have the legal authority to approve substitute
supply plans. The Court went on to say that a substitute supply plan (such as the one
operated by the Subdistrict) would either have to file for a decree in Water Court, or
follow new Rules & Regulations to be issued by the State Engineer. Either alternative
would raise the standard required for approval. Ultimately, the Subdistrict will need to
acquire more senior water rights as well as build additional storage to augment out-of-
priority diversions

Feasibility Studies
The GMS-CCWCD has completed a feasibility study. The study includes an assessment
of alternatives available to provide additional augmentation water for its members.

Water Riahts.
The GMS-CCWCD currently owns water rights as listed in Table 1:

Table 1: Water Rights Owned
Groundwater Management Subdistrict of the
Central Colorado Water Conservancy District
2002

Comoarw

Box Elder Ditch
Brighton Ditch
Farmer's Independent Ditch
Fulton Ditch
Greeley & Loveland Ditch
Greeley Irrigation Ditch
Jones Ditch
Lake Loveland
Lupton Bottom Ditch
Lupton Meadows Ditch
Rural Ditch
Seven Lakes Reservoir
Union Reservoir
Weldon Valley Ditch

TOTAL

Location

Amount
(acre-feet)

Windsor
Brighton
Platleville
Brighton
Greeley
Greeley
Greeley
Loveland
Fort Lupton
Fort Lupton
Longmont
Loveland
Longmont
Fort Morgan

50
20
81
628
413
680
15
260
600
120
53
240
200
150

3,510 acre-feet

Groundwater Recharae Proiects
In 1979, the Subdistrict began developing a groundwater recharge program to
supplement the amount of water available for augmentation purposes. Numerous sites
have been developed in the Platteville, Greeley, Fort Morgan, and Hudson areas. To-
date, over 70,000 acre-feet of water has been recharged through these various projects.
A list of projects is shown in Table 2:

2
