general principle whether we could accept, - whether we could

accept a general principle of a,division between the upper

and lower states as the primary basis of compact and Mr.

Norviel wantod to await this morning before he came to a de-

cision as to vtl1ether we could discuss it in principle, without

any obligation at all as to detail,

MR. NORVEL: Mr, Secretary and Gentlemen of the Commis-

sion;'We from Arizona are pGrfectlywilling to accept in

principle the division of the basin, into two divisions, and I

may say in this that we do not do so reluctantly, nor do we

do so liLth avidity,: but calmly, facing a, serious proposition,

for we feel in this principle that we are conceding a right

that is ours by all established rules of law and precedent.

However, we will accept the principlG and try to adjudicate

the matters on the basis of a division as suggested, a division

,of the waters,

MR, HOOVER: That will, bring us to the discussion of de-

tail. In order that,we might have as constructj~e a discus-

sion as possible we might consider for a moment the problems

involved in the detail and, attempt'to dissolve them into their

component parts~ For instance, such a division as this implies

a point of division. It has been suggested that Lee's Ferry

shal+ be the point. The second point involves a method of

Vlhat, for lack of a better v!ord, we might call averaging, and

the third point, in my mind, would' involve a principle of a

quantitative character as to the volume of water, - not as to

the method of actual division of the Vlater itself.
