<br />. <br /> <br />. <br /> <br />appropriate State authority determines that a water user is applying <br />colorado River water to a nonbeneficial or unreasonable use, or is <br />making an unreasonable diversion, the Regional Director may direct a <br />water user in writing to modify the water conservation plan to address <br />specific goals, measures, and time schedules for implementing actions to <br />reduce such nonbeneficial or unreasonable use or unreasonable diversion <br />within a reasonable time frame. upon such determination, the Regional <br />Director shall follow the procedures set forth in 43 erR Part 417. Such <br />determination is separate from the determination of nonuse under S <br />41S.10(b). The Regional Director may also direct the modification of <br />water conservation plans to meet the requirements of the appropriate <br />State authority. <br /> <br />(9) Reduction in diversion reauest. If a water use~ fails to <br />take actions required to correct the nonbeneficial or unreasonable use <br />of Colorado River water within the designated time period, the Regional <br />Director may reduce the water user's diversion request, in accordance <br />with the procedures set forth in 43 erR Part 417, in an amount equal to <br />the amount of water that the Regional Director determines is <br />nonbeneficially or unreasonably used. Any such reduction shall continue <br />to be made until the water user has elLminated the nonbeneficial or <br />unreasonable use. This reduction in diversions is separate from the <br />reduction in entitlement pursuant to S 415.10. <br /> <br />S 415.18 Environmental comoliance. <br /> <br />Reclamation will be responsible for ensuring compliance with the <br />National Environmental Policy Act, the Endangered Species Act, and other <br />applicable laws and regulations as required for actions taken pursuant <br />to these Regulations. Such actions may include, but not be limited to, <br />assignments, transfers, exchange of water, temporary sale of water, <br /> <br />0847 <br /> <br />43 <br />
