<br />. <br /> <br />. <br /> <br />and each party to an exchange commits in writing to mitigate or <br />compensate for third-party impacts of such exchanges or temporary sales <br />to the satisfaction of the Regional Director and other impacted parties, <br />including, but not limited to, the county of origin of the water user <br />offering the exchange or temporary sale. <br /> <br />(d) coordination with Reclamation. Reclamation will coordinate a <br />proposed exchange or temporary sale with the appropriate authorities of <br />the State involved in the proposed exchange or temporary sale. Any <br />exchange or temporary sale shall be short-term, which is hereby defined <br />as 1 year or less. Reclamation shall be provided a copy of all exchange <br />or temporary sales agreements. <br /> <br />(s) Additional factors Reclamation may consider in evaluatina <br />reauests for exchanaes and temDorarv sales. In reviewing a request for <br />an exchange or temporary sale, Reclamation may consider, in addition to <br />the factors set forth in paragraphs (a) and (b) of this section, other <br />factors including, .but not limited to, the following: <br /> <br />(1) A seller which is an agricultural user must maintain <br />the lands and works in a condition whereby the lands could take and <br />receive water at all times during the period of exchange or temporary <br />sale; <br /> <br />(2) If an exchange or temporary sale is made by an <br />agricultural user to a domestic UBer during the cost-repayment period <br />for Hoover powerplant, Reclamation shall assess a charge of $0.25 or <br />$0.50 per acre-foot, as appropriate, for the quantity of water exchanged <br />or sold, payable annually; and <br /> <br />(3) Exchanges of water may be settled by monetary payment <br /> <br />26 <br />
