<br />. <br /> <br />. <br /> <br />(c) Assianments of contract entitlements. contract entitlements <br />may be assigned from one entity to another, but such assignments of <br />contracts shall not be effective until approved in writing by the <br />Regional Director. In evaluating a request for approval of a proposed <br />assignment, the Regional Director ahall consider, among other things, <br />the authority and capability of the assignee to fulfill the contractual <br />obligations. The Regional Director may impose new or additional <br />contractual obligations as conditions of his approval. Transactions <br />which involve a change in ownership and a change in the type or place of <br />use shall require both an approved assignment and approved transfer. <br /> <br />(d) Transfers of entitlements. <br /> <br />(1) General. Requests for transfers must be approved in <br />writing by the Regional Director. Transfers are permitted only within a <br />State. In considering requests for transfers, the Regional Director <br />shall consider, among other relevant factors: (1) potential impacts on <br />other water users, (11) applicable law which may facilitate or constrain <br />such transfers, (iii) applicable Departmental, Reclamation, or other <br />Federal regulations, pOlicies, or guidelines in effect at the time of <br />the review, and (iv) appropriate input from authorities of the State <br />within which the transfer is proposed. The parties involved in a <br />transfer shall provide all information that the Regional Director <br />determines to be necessary to evaluate the proposed transfer. A <br />proposed transfer of a PPR not covered by a contract with the Regional <br />Director shall not be considered by the Regional Director unless the <br />execution of a contract is included as part of the transaction. <br />Transfers of Federal establishment entitlements shall not be authorized. <br /> <br />(2) Transfers limited to historical consumotive use. The <br />maximum amount of water that may be approved for transfer shall be based <br /> <br />23 <br /> <br />0857 <br />
