<br />., <br /> <br />1 assure repayment; <br />2 (c) The applicant is able to show the ability to collect <br />3 payments for the augmented water from its members; <br />4 (d) The loan will assist in maintaining the agricultural <br />5 viability of the Arkansas river valley; <br />6 (e) The appl icant obtains conunitments frolJl its members <br />7 that the member will cease pumping water 1~ such member fails <br />8 to make payments in accordance with the loan agreement; and <br />9 (f) The applicant obtains coltlllitments from its members <br />10 to comply with the rules and regulations promulgated by the <br />II state engineer that govern the measurement of ground water <br />12 withdrawal s and the use of such ground water in the Arkansas <br />13 rivei basin. <br />14 (5) (a) The state engineer shall promptly and completely <br />15 curtail the use of a well by the owner of such well, if such <br />16 owner has accepted the benefit of a loan made pursuant to <br />I7 subsection (1) of this section and fails to mak.e a payment <br />18 required pursuant to the contract. <br />19 (oj Curtailment pursuant to this subsection (5) shall <br />20 remain in effect for as long as any payment remains past due. <br />21 SECTION 2. Arlc:ansas river channel restoration study - <br />22 authori zati on. (1) The Colorado water conservat i on board is <br />23 hereby authorized to contract with Albuquerque District, Corps <br />24 of Engineers or a contractor for a study that will investigate <br />25 problems related to recent flooding and identify and evaluate <br />26 potential solutions to address channel conveyance, sediment <br /> <br />-4- <br /> <br />124 <br />
