<br />., <br /> <br />aquifers if appropriate recharge sites can be obtained. Several gravel pits are being evaluated <br />for recharge feasibility. The associations are also considering delivering the water to the <br />Stateline during the irrigation season when it would be usable by Kansas irrigators. <br /> <br />Through authorization contained in Senate Bill 96-124 (see Appendix A), LA WMA <br />will receive a loan of up to $3,750,000 from the Colorado Water Conservation Board to <br />acquire augmentation water or water rights to replace out-of-priority depletions by its <br />members' wells. The bill requires the State Engineer to curtail the use of any well whose <br />owner has benefited from this loan and who fails to make a required payment pursuant to this <br />loan. The X-Y Ditch will be purchased and approximately 3,000 acres removed from <br />irrigation in order to replace depletions to usable Stateline flows by member wells. <br />LA WMA also will purchase other water rights to have sufficient replacement water to <br />comply with the 1996 Use Rules. <br /> <br />Southeastern Colorado Water Conservancy District (SECWCD) <br /> <br />On September 21,1995, the SECWCD Board of Directors formed the Southeastern <br />Colorado Water Activity Enterprise (SECW AE) for the purposes of allocating the return <br />flows from Fryingpan-Arkansas Project deliveries and development/administration of a well <br />augmentation plan for well owners within the boundaries of the SECWCD. Since that time, <br />the Board determined that the SECW AE will not offer a separate plan in 1996. Instead, the <br />SECW AE has chosen to work in cooperation with existing well augmentation organizations. <br />Toward that end, SECW AE, AGUA, and CWPDA have agreed to a set of Coordinated <br />Augmentation Program Principles (see Appendix. B). These principles specify that sales of <br />project return flows will be made for use in replacement plans approved in accordance with <br />SECW AE Approval Standards and Procedures (see attachment to Appendix B) and subject <br />to Return Flow Water Sales Policies (see Appendix C, as revised to date). Furthermore, an <br />Alliance Agreement has been adopted whIch 'seeks to consolidate AGUA and CWPDA into <br />a single organization (see Appendix D). <br /> <br />Recendy, the SECWCD's Allocation Conunittee voted to recommend that an <br />allocation of up to IS ,000 acre feet of first use project water from supplies not allocated in <br />1995 be made available for augmentation purposes in conjunction with project return flows <br />to be made available in 1996. <br /> <br />Support Cor 1996 Use Rules <br /> <br />Pleadings in support of the 1996 Use Rules have been filed by LA WMA, SECWCD, <br />and the Upper Arkansas Water Conservancy District.
