<br />000885 <br /> <br />(3) The last section of S. 2246 has been moved forward to <br />constitute ,) new Section 3 in S. 1111. In addition, the <br />wordll1g has been clarified to specify that nothing in the <br />Act is to be construed as either expanding or diminishing <br />either Federal or State jurisdiction, responsibility or <br />rights with respect to water resources, nor as superseding, <br />modifying or repealing existing laws applicable to the <br />various Federal participating agencies, nor to affect the <br />jurisdiction of international commissions. When the <br />Senate Committee reported the bill on November 26, 1963, <br />it amended this section to include language stating that <br />nothing in the Act shall be construed to displace, super- <br />sede or lImit any interstate compact or the jurisdiction <br />or responsibility of any legally established jOint or <br />common agency of two or more States. <br /> <br />The above changes seem designed to allay the fears of those who <br />feel that States' water rights might be affected by the Bill, and the objection <br />that where an interstate commission is already established, another river <br />basin commission will not supersede it. At the time the Bill was reported <br />by the Senate Committee there was still doubt in the minds of those of us <br />closely associated with the Upper Colorado River Commission that the <br />language adopted by the Senate Committee was adequate in this latter <br />respect. We preferred to have language in the Act that would provide that <br />for any river system which has had its water or the use of its water <br />apportioned between sub-basins under the provisions of an Act of Congress <br />or by an interstate Compact to which the consent of Congress has been <br />given each sub-basin shall be treated as a separate river basin. <br /> <br />(4) Section 101 of S. 1111 has been modified by the addition <br />of the Chairman of the Federal Power Commission to the <br />W cter Resources Council. <br /> <br />(5) In Section 102 of S. 11ll, the Council is charged with <br />maintaining a continuing study and preparing a biennial <br />assessment of the adequacy of supplies of water rather <br />than the adequacy of supplies of good quality water as <br />in S. 2246. <br /> <br />(6) Th", language of Section 103 has been made clear that the <br />Council shall establish, with the approval of the President, <br />principles, standards, and procedures for Federal partici- <br />pants in the preparation of river basin plans. In S. 2246, <br />it was not clear whether this language was intended to <br />go beyond Federal participants and include all participants. <br />Also, the procedures may include provisions for Council <br />revision of plans for Federal projects being prepared by <br />a river basin commission. <br /> <br />-' 4 - <br />
