This agreement is tentative pending approval of other <br /> <br />environmental organizations. <br /> <br />This package of environmental provisions greatly enhances the <br /> <br />environmental protection associated with this pre-NEPA project. <br /> <br />OTHER POLICY ISSUES <br /> <br />As indicated, policy issues associated with transfer of title <br />of the federal facilities, have now been obviated. Questions with <br /> <br />the United States Forest Service regarding the transfer of the <br /> <br />underlying land, its fair market value and avoiding future <br /> <br />speculative uses of the land are all avoided. <br /> <br />Issues about <br /> <br />valuation of federal facilities upon a transfer are likewise <br /> <br />avoided. The existing contract will remain in effect except for <br />the single payment in lieu of future construction payments and for <br /> <br />the transfer of O&M functions. <br /> <br />Contract provisions concerning <br /> <br />reclamation law, such as acreage limits, remain in effect. <br /> <br />In discussions with environmental interests a major concern <br /> <br />emerged relating to the possible future inclusion of segments of <br /> <br />the Conejos River in the National wild and Scenic River System, <br /> <br />including the segment downstream from Platoro Reservoir. The river <br /> <br />was studied by the Forest Service, resulting in recommendations for <br /> <br />12 <br />
