<br />13 <br /> <br />2()1 <br />"'" <br /> <br />!" <br /> <br />r <br /> <br />provision in the Treaty that Mexico shall pay a proportionate <br />part of the capital cost of those facilities and also of the <br />annual cost of maintenance and operation, which is to be deter- <br />mined by agreement under certain. criteria laid down by the <br />Treaty by the International Boundary and Water Commission with <br />the approval of the two governments; and what the District <br />says here is that as far as they are concerned, their compensa- <br />tion for making these deliveries to Mexico shall be determined <br />by the United States. <br />"It is to be understood, however, that there shall <br />not be included in any such compensation any amount repre- <br />senting payment for the construction cost of such facilities <br />used by said district in furnishing such services. <br />"In the event the United States decides not to turn <br />over to the District the care. operation and maintenance of <br />Imperial Dam and Laguna Dam, or either of them, as provided <br />hereinabove, then the United States need not 10 so; and this <br />agreement shall be considered as modified to that extent, bult <br />only to that extent, and all other provisions hereof shall <br />remain in full force and ef'f'ect." <br />Now subdivision No. 2 relates to: <br />" <br /> <br />.American Ce.nal, there was agreement among those attending <br /> <br /> <br />the meeting above ref'erred to o~eptember 15 and 16 that the <br />
