Legislation be enacted to permit a reservoir owner to recapture <br /> <br /> <br />seepage water when this does not injure a vested right. <br /> <br />10. The preferential uses in the constitution be enlarged and <br /> <br /> <br />defined to cover changed conditions, i.e., municipal, industrial <br /> <br /> <br />and others. <br /> <br /> <br />11. Conversion of direct flow rights to storage rights be permitted <br /> <br /> <br />to the extent that other vested rights are not impaired. It is <br /> <br /> <br />further recommended that this determination be a function of the <br /> <br /> <br />state engineer. <br /> <br /> <br />l~, Water Courts be e~tabl ished to hear water and other closely ~elated <br /> <br /> <br />cases. <br /> <br />13. New laws be enacted to strengthen and clarify those relating to <br /> <br /> <br />abandonment of absolute decrees and cancellation of conditional <br /> <br /> <br />decrees. A period of non-use should be adopted as prima facie <br /> <br /> <br />evidence of an intent to abandon water rights. Excessive water <br /> <br />rights should be reduced. Abandonment determinations and <br /> <br />cancellation of conditional decrees should be initiated by the <br /> <br /> <br />state engineer. <br /> <br />14. Authority be granted to the state engineer to authorize a change <br /> <br /> <br />in point of diversion after notification to interested parties <br /> <br /> <br />and administrative hearings. Any decision by the state engineer <br /> <br />would be subject to appeal. <br /> <br />15. Laws regarding filling of reservoirs be enacted to specify when <br /> <br /> <br />carry-over water in storage is charged against the storage <br /> <br />rights for subsequent reservoir fillings. <br /> <br /> <br />16. Laws be enacted providing for better enforcement of the <br /> <br /> <br />water statutes, judicial decrees and orders of the state engineer. <br /> <br />17. Terminology be defined by statute to assist the water officials <br /> <br /> <br />in eliminating waste and provide more flexibility in util izing <br /> <br /> <br />the water resources of the state.
