E.2 NEGOTIATION--RECLAMATION (DEC 1987) <br /> <br />If.discussions are necessary, the Contracting Officer (CO) will enter <br />into such discussions with those offerors whose response to this <br />Request for proposals (RFP) falls within the competitive range. The <br />competitive range will be established by the CO after the evaluation of <br />technical proposals. The CO will determine which proposals are in the <br />competitive range in accordance with the procedures set forth at <br />Federal Acquisition Regulation (FAR) 15.609. <br /> <br />E.3 NOTICE OF POSSIBILITY OF AWARD WITHOUT DISCUSSION--RECLAMATION <br />(DEC 1987) <br /> <br />Offerors are cautioned to review carefully all terms, conditions, and <br />specifications of the solicitation prior to submission of proposals. <br />If the proposals received clearly demonstrate the existence of adequate <br />competition, and, if acceptance of the most favorable initial proposal <br />without discussions would result in a fair and reasonable price for the <br />work and represent the lowest overall cost to the Government, then the <br />Government reserves the right to accep~ initial proposals without <br />discussion. Offerors are cautioned that each proposal should be <br />prepared based on the most favorable technical terms which can be <br />submitted, since acceptance of an initial offer by the Government will <br />result in a legally binding contract. <br /> <br />E.4 RESPONSIBILITY SURVEY--RECLAMATION (DEC 1987) <br /> <br />If an offer submitted in response to this solicitation is favorably <br />considered and included in the competitive range, a Government survey <br />team may contact the offeror's facility to determine its financial and <br />technical ability to perform the work. Current financial statements <br />and other data required to make these determinations shall be made <br />available to the survey team. <br /> <br />E.5 AWARD DETERMINATION--RECLAMATION (DEC 1987) <br /> <br />Proposals will be evaluated to determine those offers which are within <br />the competitive range, technical and other factors stated in the <br />solicitation considered. Negotiations may be conducted with all <br />offerors whose proposals are determined to be technically acceptable or <br />technically acceptable with modification and are included in the <br />competitive range. <br /> <br />E-3 <br />
