<br />. <br /> <br />. <br /> <br />Because no supporting data for this document is currently available, I recommend that the <br />staff prepare a letter for the Service stating that we reserve the right not to comment until <br />all of the supporting data and pertinent documents are available for our review. To that <br />end, it may be in the best interest in the Board staffs (as well as the Upper Yampa River <br />Conservancy District's) time to postpone the March 17, 1993 meeting with John Fetcher <br />until this supporting data has been received and reviewed by the staff. The Service expects <br />to finalize the proposed rulemaking process in September, 1993. <br /> <br />It will be helpful to the process to initially meet amongst ourselves for discussion of this <br />issue and development of some type of strategy with which to proceed. The Division of <br />Wildlife and other affected agencies should be notified that a single State response to the <br />proposed ruling will be developed. This can be done in a multi-agency meeting with a <br />"designated" point person to put together such a packet, or done in-house by each agency, <br />putting several letters from Directors under a transmittal letter from Ken Salazar. This will <br />be reviewed by the Attorney General's Office. The Board may consider taking public <br />comment at the May, 1993 Board Meeting. <br /> <br />There are numerous concerns that will need to be addressed by all affected agencies within <br />the State. These issues include, but are not limited to: <br /> <br />o How future development of Colorado's compact apportionment will be <br />impacted; <br /> <br />o The role that the Section 7 Consultation process will present on future and <br />existing projects; <br /> <br />o Is the proposed rule based on reasonable, accurate and technically sound data <br />(supporting documents); and <br /> <br />o How the ruling would impact fisheries and other wildlife resources associated <br />with the designated habitat. <br /> <br />For scheduling purposes, we suggest a meeting in our library at 10:00 a.m. on March 9, 1993. <br />Please let me know if you agree with the need for this meeting, and then if the date works <br />for you.
