P.E.
OIredor, eweB

FROM: Sue Uppendahl :;v.-t

SUBJECT: Schedule for the Proposed Rule on Designated Critical Habitat for the
Endangered Fishes of the Upper Colorado River Basin

DATE: March 1, 1993

Following review of the Endangered Species Act (Act) of 1973, as amended (16 U.S.c. 1531
et seq.), and the proposed rule (58 Fed. Reg. 6578, January 29, 1993) to designate 2,094
miles of river within the Colorado River basin, I believe it is essential that the State of
Colorado coordinate among its agencies involved with the Recovery Program and develop
a State Position. The State's interests in water and wildlife resources must be protected,
while meeting the goals and objectives in recovering these species under the Act.
In summary, the U.S. Fish & Wildlife Service (Service) is designating 2,094 miles of riverine
habitat within the Colorado River Basin as critical habitat for the Colorado squawfish,
humpback chub, bonytail chub and razorback sucker. This designation was conducted by
the Service under a court order and was apparently done in a "limited" time frame, and
therefore was done without supporting documents available to the public. The Service is
requesting that public comment be given on the proposed rule by March 30, 1993, and that
three supporting documents listed below will be provided at a later date. The current
schedule is as follows:

March 30, 1993

Comments on Proposed Rule

?June, 1993?

Biological Support Document by the Service

?June, 19931

Economic Analysis by the Service

To Be Announced

Evaluation of Effects of Critical Habitat Designation

To Be Announced

Public Hearings on the Proposed Rule
