While prepared as an environmental assessment (40 CF.R. S 1508.9), this document was <br />also prepared to provide information for the purposes of 50 CF.R. SS 402.13(c)(1-6). As the <br />Proposed Action, i.e., a series of experimental flows, is not a "major construction activity," as that <br />term is used in 50 CF.R. S 402.12(b), preparation of a biological assessment, as defined in <br />50 CF.R. S 402.02, is not required by regulation, but has been prepared to facilitate compliance <br />with S 7(a)(2) of the Endangered Species Act. <br />
