During the months of June through October when deliveries <br /> <br />to direct-flow users are at or less than 100% of the Del <br /> <br />Norte Index, "pre-compact" reservoirs may be permitted to <br /> <br />store out of priority under the fOllowing provisions: <br /> <br />(a) Reservoirs will store quantities of water not to exceed <br /> <br />the amount of return flow developed below the Del Norte <br /> <br />gaging station and above the New Ditch headgate near <br /> <br />Alamosa. This storage will be determined on a daily <br /> <br />basis and the daily amount so stored will be added to the <br /> <br />fOllowing days Del Norte index to ensure that junior <br /> <br />rights in priority are not deprived of legally available <br /> <br />water. <br /> <br />(b) The amount of storage on any given day will be deter- <br /> <br />mined by the availability of return flows to satisfy those <br /> <br />decrees actually in priority and upon the actual inflow <br /> <br />to the reservoirs. <br /> <br />(c) Daily records of such storage will be maintained to <br /> <br />penn it determination of all operations and water <br /> <br />entitlements. <br /> <br />(d) All storage under these Provisions will be considered <br /> <br />as out-of-priority storage.
