There will be no direct flow diversions from the Rio Grande <br />or its tributaries during the months of January, February and <br /> <br />! .-" <br /> <br />March except for those rights decreed for use throughout the <br /> <br />year l Storage in pre-compact reservoirs will be permitted <br />. I <br /> <br />during this period provided that 15 percent of all water stored <br /> <br />shall be considered as stored out of priority in accordance <br /> <br />with the Colorado Revised Statutes, chapter 148-11-25, as <br /> <br />amended. This water may be called by the State Engineer for <br /> <br />compact commitments if required, but any water so stored and <br /> <br />carried over to January I of the following year will revert to <br /> <br />absolute ownership of the reservoir in which it was held. <br /> <br />In the event any reservoir should spill, the out-of-priority <br /> <br />water will be the first to spill. <br /> <br />3. April throuqh October <br /> <br />a. Direct flow divers ions may commence upon a date to be <br /> <br />determined annually by the State Engineer after consultation <br /> <br />with the Rio Grande Water Conservation District, the Rio Grande <br /> <br />Water Users Association, arid other interested entities. <br /> <br />b. Actual runoff at the Del Norte Index Station for the months <br /> <br />of January, February and March and the estimated runoff for <br /> <br />November and December will be combined to provide an estimated <br /> <br />supply at the index station'during the non-irrigation months of <br /> <br />the calendar year.
