<br />I' <br /> <br />II <br />I <br />I <br /> <br /> <br />may become availoble to the District or landowners <br />within the District other than pursuant to the terms of <br />this contract if the Secretary defermines that such <br />mingling is necessary to avoid duplication of facili- <br />ties; and notwithstanding such mingling of water the <br />provisions of this confract shall be applicable to the <br />quantity of wafer furnished to the District pursuant <br />to the terms hereof, and such mingling of wafer shall <br />not in any manner subject the quantity acquired by <br />Of o.'1oilab\e ~o ~he Di!'~ri(' OT landowners within tne <br />District other than from the United Stotes to the pro- <br />visions of this contract. <br /> <br />Books, Records, al1d Reports <br /> <br />25. The District shall establish and main1ain ac- <br />counts and otner books and records pertaining to its <br />financial transactions, land use and crop production, <br />water supply, water use, and to such other matters' <br />pertaining to this controct as the Secretary may reo <br />. quire. Reports thereon shall be furnished to the <br />United Stotes in such form and on such date or dates <br />as may be required by the Secretory. Each party <br />shall hove the right, dLJring office hours, to examine <br />and make copies of the other party's books and of- <br />ficial records relating to matters covered by this con- <br />tract. <br /> <br />Changes in Organization of District <br /> <br />26. While this contract is in effect no changes <br />shall be made in the District either by inclusions or <br />exclusions of land by dissolution, consolidations, <br />merger, or otherwise, except from the Secretary's <br />written Clssent thereto. <br /> <br />Contingent Upon Appropriation <br />or Allotment of Funds <br /> <br />29. The expenditure of any money or the per- <br />formance of any work by the United States hereun- <br />der which may require appropriations of money by <br />the Congress or the allotment of funds shall be con- <br />tingent upon such appropriations or ollotment being <br />made. The failure of the Congress so to appropriate <br />funds or the absence of an allotment of funds shall <br />not relieve the District from any obligations then ac- <br />crued under this controct, and no liability shall ac. <br />crue to the United States in case such funds are not <br />appropria1ed or allotted. <br /> <br />10 <br />
