(3) The District shall not use or sell any of the

lands conveyed to it for private, co~~ercial or residential

development, although the District nay use said lands for

reservoir or hydroelectric facilities, upon consultation

wi th the united States Forest Ser\li.ce ..regarding the location

and type of !?-'.lC'.h i!!l.p!'cvenents.

(4) The District shall maintain releases of water from

Platoro Reservoir of at least 5 cubic feet per second during

the months of October through April in order to preserve

fish and wildlife habitat.

The District has previously

agreed with the state of Colorado to subordinate its rights

to those of the State to maintain instrearn flows of 40 cubic

feet per second during the months of May through September.

(e) RELIEF OF RESPONSIBILITY AND LIABILITY OF THE UNITED

STATES.--The transfer under subsection (b) shall relieve the

iated with operation and maintenance of the project for irriga-

tion, safety of dams, or any other purpose except recreation with

respect to the Platoro Reservoir and except for flood control

administration by the corps of Engineers, Department of the Army.
All operational, naintenance and replacement responsibilities and

expenses shall be the responsibility of the District.

(f) !1ANAGEHENT. --The Corps of Engineers, Depart-Dent of the

Army, shall retain authority for management of Platoro Dam and
