<br />~ <br />,-... <br />;~ _J <br /> <br />C\l <br />(...1 <br />C::.; <br /> <br />. <br /> <br />. <br /> <br />(d) THE T~llSFER UNDER SUBSECTION (b) SEA:'L BE SUBJECT TO <br /> <br />CONOITIONS IMPOSED UPON THE D:S~RIC~ AS FOLLOWS: <br /> <br />(1) The District will use its best efforts to operate <br /> <br />the reservoir in such a way as to provide that releases of <br /> <br />bypasses frcm the reservoir flush out the ch~nnl?_l.C'f_. the <br /> <br />Cone;os River-.!1priodically in the spring Or early summer to <br /> <br />maintain the hydrologic regime of the river, and to provide <br /> <br />that any releases from the reservoir cont:::-ibu":e to even <br /> <br />flows in the river as far as possible fron October 1 to <br /> <br />December 1 so as to be sensitive to th~ brown t:::-out spawn; <br /> <br />provided, hOlvever, that the operation of the reservoir by <br /> <br />the District for ~Iater supply uses (including storage and <br /> <br />exchange of the Ivater rights owned by the Dis1:rict or its <br /> <br />constituents), and interstate compact and flood control <br /> <br />purposes shall be senior and paramount to the aforedescribed <br /> <br />channe~. fl~~~ing and fishery objectives, and <br /> <br />(2) The District will provide and maintain a permanent <br /> <br />pool in Platoro Reservoir for fish, wildlife and recreation <br /> <br />purposes, in the amount of 1800 acre-feet, including the <br /> <br />initial filling of the pool and periodic replenishment of <br /> <br />seepage and evaporation loss. <br /> <br />Further, if the District <br /> <br />commits additional storage and water up to 1200 acre-feet <br /> <br />for the purpose of guaranteeing instream flows below the <br /> <br />Dan, the District further agrees that such additional <br /> <br />storage and water will also be held to enhance the permanent <br /> <br />pool unless and unto j 1 n.ee.dGd. fo-r. -instred"m fiot:} -releases I and <br /> <br />, <br />~ <br />
