"~"'- ': . <br /> <br />'\ '.." <br /> <br />,_.t"'"" <br />t'r, ~~ ' <br /> <br />MINORITY VIEWS <br /> <br />We can well sympathh:e with the people of Arizona and their Sena- <br />tors in their efforts to obtain supplemental water for an expanding <br />economy. As Senators from Western States we are all keenly aware <br />of the necessity of an adequate water supply to the economic well- <br />being of a community. Nevertheless. we feel compelled to oppose the <br />enactment of this bill unless the fOllowing amendment is adopted: <br />On page 16, between lines 16 and 17, insert the following new <br />section: <br /> <br />SEC. 104. (a) The projects and works authorized by this <br />Act shall be operated so that no waters shall be diverted <br />or used by means of the project works which, together with <br />all other waters used in or diverted from the Colorado River <br />System" as such system as defined in article 11(a) of the <br />Colorado River compact (46 Stat. 3000) for use in or the <br />benefit of the lower basin" as such basin is defined in article <br />II(g) of said compact, will cause to be exceeded in any year <br />the total beneficial consumptive use allocated to the lower <br />basin under article III ofthe compact; and all contracts en- <br />tered into for the delivery of water from or by means of the <br />projects authorized by this Act shall embody the provisions <br />of this limitation. <br />(b) In computing the quantity of beneficial consumptive <br />use of water in the lower basin, as such quantity is defined <br />and limited by article III (a), (b), and (c) of the Colorado <br />River compact, the Secretary of the Interior is directed to <br />include all diversions or uses of water from the Colorado <br />River system less such return flows as are usable and avail- <br />able for further use under compact or treaty allocations, <br />evaporation from any and all Colorado River system reser- <br />voirs constructed in or for the benefit of the lower basin, and <br />any other uses which are chargeable to the activities of man <br />in the lower basin. <br />(c) Beginning with the first day of October next succeed- <br />ing the delivery of water from any of the projects authorized <br />by this Act, and for every full year ending on the last day <br />of September thereafter, the Secretary shall prepare and de- <br />liver to the Governors of the States of Arizona, California, <br />Colorado, Nevada, New Mexico, Utah, and Wyoming, an an- <br />nual accounting of the water uses in the lower basin as herein <br />defined. <br /> <br />Renumber the remaining sections accordingly. <br />The necessity of this amendment, which the committee declined to <br />adopt, stems from the fact that there has been little or no attempt <br />to properly account for water uses in the lower basin. A further com- <br />plication arises from the assertion of Arizona in Arizona v.
