The resulc <br />will be a calculacion of the tocal amo~nt of water which it would <br /> <br />appear the Indian cribes might claim based upon asserted and estimaced <br />claims relating to irrigacion. <br /> <br />This estimaCe will not be the same as an estimate derived <br /> <br />t:hrough application of the legal standard of "practicably irrigable <br /> <br /> <br />acreage" as enunciated by the Supreme Court, although ic is suggest-, <br /> <br /> <br />ed that so:::e of the same factors would be considered in arriving at <br /> <br /> <br />either estioate. The parameters of the "praccicably irrigable <br /> <br /> <br />acreage" s:andard have not yet been definitively established by che <br /> <br />Court. It seems clear, however, that the standard will involve a <br /> <br />very complicated, technical and sice-specific analysis of physical <br /> <br />and econooic factors relating to irrigacion on che reservation in <br /> <br />quest:ion. Given the lack of information that would be necessary, <br /> <br /> <br />undertaking such an analysis for all lndian reservations in the <br /> <br /> <br />West is well beyond the scope of this proposal. <br /> <br />On tr.~ ocher hand, claims have been asserted based upon the <br /> <br /> <br />"practica!l.ly irrigable acreage" standard and infor.nation is avail- <br /> <br />able relating co Indian reservacion lands which are irrigable. <br /> <br />-3- <br />
