<br />iHl22S6 <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />vn. Relief from the ESA <br /> <br />A The "God Committee" and the !$ 7(e) Exemption Process. <br />1. After consultation and the final biological opinion. the federal agency. state <br />governor. or permit applicant can apply to the Secretary to exempt the <br />proposed action from the consultation process veto. <br />2. The Secretary has 20 days to make certain determinations; if these are not <br />met, the Secretary must deny the permit immediately. <br />3. If the determinations are met, the Secretary must transmit a report to the <br />Endangered Species Committee [1be "God Committee"]. 16 U.S.c. <br />~1536(g)(5). <br />4. The God Committee can grant an exemption only if 5 of its 7 members find <br />that: <br />a. no reasonable/prudent alternatives exist; <br />b. benefits of the action clearly outweigh the benefits of alternatives; <br />c. the action is in the public interest; <br />d. the action is of regional or national significance; and <br />e. no prohibited irreversible or irretrievable commitment of resources <br />will take place. 16 U.S.c. ~1536(h)(I). <br />5. The decision of the Committee is subject to judicial review in an appropriate <br />U.S. Court of Appeals. <br /> <br />B. Additional exceutions -- Section 10. <br />1. Section 10(a) allows the Secretary to permit incidental takings by private <br />landowners who do not need a federal permit under section 7. 16 U.S.c. <br />~1539 (a)(1). <br />2. No exception can be granted for any activity that jeopardizes the continued <br />existence of an endangered species, and the taking must be incidental to an <br />otherwise lawful activity. 16 U.S.c. ~1539(a)(I)(B). <br />3. Applicant for permit must submit a "conservation plan" to the Secretary. <br />specifying the likely impact of his action; mitigation measures; alternatives <br />to the taking; and other measures required by the Secretary. <br />4. Secretary must revoke the permit if he finds that applicant is not complying <br />with permit terms. <br />
