Knapp I <br /> <br />This will acknowledge receipt of your letter of July ~lst, with <br />enclosures, which reached this office juet as I was lesving for a two-day <br />trip to Pueblo e.n" Colorado Springs and vicinity, hence the delay in re- <br />plying thereto. <br /> <br />.' <br /> <br />As yet I have not had time to give careful study to the results <br />of your computation!; and method of approach, from which you tentatively <br />conclude that Kansas is entitled ~o about l5,000 acre feet of water on <br />August lat. This I hope to be able to do within the next few daya. In the <br />meantime, I am subnitting herewith a tabulation of factual data compiled <br />from the official records of diversions ~ Colorado ditches above end below <br />Ceddoa Heservoir, and of deliveries across the state line. As noted in the <br />tahulstion, the figures for April, Mey end June are baaed upon charts from <br />the automatic recorders and include reservoir releases. <br /> <br />The figures for July are based upon the daily reports of the <br />A.V.D.A. bulletin, since all of the charts from the recorders for July have <br />not as yet been. received, hence the figures for July are subject to So~e <br />revision as soon as the charts have -oeen worked up. <br /> <br />According to this tabulation the 194~ diversions by ditches above <br />Caddoa Reservoir have amounted to 15,~50 acre feet more than the hi&toris <br />or status quo diversicns permitted ~ the stipulation, and the 1945 diver- <br />sions -qr Colorado ditches below the reservoir have exceeded historic or <br />status quo diversioIlE by 6,042 acre feet. <br /> <br />O-Jr tabulations snow tnat there _5 delivered across the state <br />line during ~he four month period 55,456 acre feet, which is 2+.772 <br />acre feet in excess of historic diversions of 51,664 acre feet, according <br />to Mr. Patterson's tabulations. <br /> <br />.'-- <br /> <br />Both historic and 1945 diversions by Colorado ditches above <br />Caddoa include reservoir releases for several of the ditches. Practically <br />all such diversions in 1945 were out of reservoir water stored during the <br />non-irrigation period, and prior to the effective date of the. stipulation, <br />but such reservoir diversions were included in the 1945 ditch diversions <br />to permit a comparison to be made with historic diversions, "hi:h, as <br />stated, do include reservoir water. It is probable also that diversions <br />to August 1, 1945 by ditches above Caddoa, include considerable trens-_ __ ___ <br />__mo\llltain -water which was not -availableduring-theee.rlj yeari;--coVerea bj <br />the record of historic diversioos by those ditches. <br /> <br />The second page of the enclosed tabulation also discloses <br />that the Cole:-ado ditches bale... Caddoa diverted during the period, 90,n~ <br />acre feet which, upon the r&tio of 52,000 to 1l7,900, would have entitled <br />
