<br /> <br />o <br />o <br />r":.) <br />c..., <br />c.o <br />c.o <br /> <br />. <br /> <br />. <br /> <br />SAN JUAN RECOVERY PROGRAM <br />SECTION 7 AGREEMENT <br />MINOR DEPLETION ACCOUNTING PROCESS <br />September 13,1999 <br /> <br />When determining whether or not a minor depletion should be accounted for as included <br />in the environmental baseline or charged to the "minor depletions account" the following <br />procedures are recommended, <br /> <br />Colorado <br /> <br />1. The D,S, Fish and Wildlife Service (Service) will henceforth inform an "action <br />agency" that the following information should be provided as part of a "biological <br />assessment" or any request for a Section 7 Consultation, <br />a, A complete description (structure name; location, appropriation date, adjudication <br />date, amount, and decreed uses) of all the water rights upon which a project or <br />action will rely, A printout or page from the "Colorado Water Rights Tabulation" <br />highlighting the water rights would be a highly desirable appendix to any request. <br />b, All records of historic use of the project water rights that the action agency would <br />like considered in the consultation process, <br /> <br />2, The Service will convey the water right information supplied by the action agency to <br />the Colorado Division of Water Resources - DivisionVII Water Engineer at the <br />following address: ' <br />Division VII Water Engineer <br />Colorado Division of Water Resources <br />P,O, Box 1880 <br />Durango, Colorado 81302-1880 <br />Phone (970) 247-1845 <br />FAX (970) 247- <br /> <br />3, The Division Engineer will verify the information and supply the Service with <br />appropriate diversion data for the water rights from existing records. That diversion <br />data will include the available period of record, the average first and last day used <br />each year, the average daily diversion, and the maximum and minimum amount <br />diverted for a selected period of time prior to October 31, 1991, The same <br />information will be supplied for the most recent period (10-years if available) after <br />October 31, 1991, This information will be provided back to the Service within 15 <br />working days, <br /> <br />4, Based on this information the Service, in consultation with the action agency and <br />Division Engineer as appropriate, will determine the amount of depletion that is part <br />of the October, 1991 baseline and the amount of depletion that should be considered a <br />new use and charged against the "minor depletion account." <br />
