<br />- Request clarification of new customer market area. <br /> <br />b. Discussion: <br />The above comments have been grouped for discussion into the following <br />numbered categories: <br />(1) Southern Division Withdrawal; and <br />(2) New Customer Market Area. <br /> <br />(1) Southern Division Withdrawal. The principal <br />arguments raised were (1) that it is inappropriate to market <br />hydroelectric resources physically located in the Northern Division <br />outside of that division, and (2) that the Southern Division <br />allocations were intended to be permanent. These issues were <br />discussed in detail in the September 1984 publication, 49 FR <br />34912-914, and will not be repeated here. Western's tentative <br />conclusion in 1984 was that the spirit of the allocation made in 1962 <br />should be maintained, but that adjustments should be made to reflect <br />changing circumstances. <br /> <br />No new arguments were advanced that persuade Western that the proposed <br />compromise is inappropriate. One commenter requesting Western to <br />reconsider allocating to the Southern Division stated that "...to do <br />otherwise would represent an abuse of the discretion vested in <br />Western ~" Another commenter quoted excerpts from 1955 House and <br />Senate reports to support the position that Western does not have the <br />authority or "option" to withdraw allocations from the Southern <br /> <br />33 <br />
