a. It is doubtful that a water quality permit from
the Colorado Water Quality Control Commission will be
required inasmuch as the water for hydroelecteric pur-

poses will be diverted from a man-made canal and the

generation of electricity will be non-consumptive and
non-polluting.

b. As noted, by statute, no Colorado permit for
diversion is required.

c. Applicant is in the process of performing its own
surveys in order that applications for determination of
water rights for the hydroelectric aspects of the pro-
ject may be completed and filed. Copies thereof will be
available, if requested, and when Rulings thereon are
obtained, copies will be furnished to the Federal
Energy Regulatory Commission.

Applicant is advised there are presently in existence a
decree or decrees for the Uncompahgre Federal Reclama-
tion Project, but the extent thereof is presently
unknown. The primary purpose of the Uncompahgre
Project is irrigation, and this applicant will not, in
any way, interfere with that primary purpose.
