7.4 When may the Secretary object to a water resources project?

In order to object to a water resources project, the Secretary must
first determine that the project would have both a direct and adverse
effect on a river. (February 7, 1969)

7.5 Does the moratorium on water .resources 0 ects
b ii extend to an river that a State ma
for inclusion in the National System?

No. The one year protection provided by section 7(b)(ii) to rivers
which are considered by the Secretary for inclusion in the system
'under section 2(a)(ii) is limited to those rivers listed in section
5(a) as study rivers, rather than to any. river that a particular State
m~ propose to the Secretary for inclusion in the system.
. The initial provisions of section 7(b) only restrict the activities of
the Federal Bower Commission and other agencies of the United States
insofar as they relate to section 5(a). rivers. The five-year exten-
sion likewise applies only to section ~(a) rivers, since the Act
speaks in terms of "such rivers." Subsection 7(b)(ii), although it
contains the phrase "any river", provides an additional period of.
protection for only those rivers considered in subsection 7(b) (i).! It
follows, that subse~tion'(ii) relates back and supplements the protec-
tion provided section 5(a) rivers by subsection (i). (April 22, 1969)
Yes. Rivers in the system under State administration are subject to ,.
the protective provisions of section 7(0.) to the same extent as those
rivers under Federal' administration. Nothing in the Act or the legis-
lative history indicates that the limitations on the construction of
water resources projects should apply differently to those rivers
authorized for inclusion by Act of Congress from those adopted through
the State legislative process and approved by the Secretary.
