<br />yield of Wolford Mountain Reservoir, including the Fish <br />Pool. <br /> <br />E. This MOU replaces and supersedes the original MOU signed <br />February 7, 1990. <br /> <br />V. Term and Termination: <br /> <br />This MOU is intended to provide a reasonable and prudent <br />alternative for the Biological Opinion for Wolford Mountain <br />Reservoir and as such will remain in place subject to the following <br />terms and conditions: <br /> <br />A. The River District shall provide the Fish Pool water to <br />the Service as long as it continues to be determined by <br />the Service that carrying out this MOU will satisfy the <br />reasonable and prudent alternative as described in the <br />Wolford Mountain Reservoir Biological opinion <br />dated <br /> <br />B. At any time during the term of the MOU, if the River <br />District acquires an alternate source of water for the <br />Wolford Mountain Reservoir Fish Pool which is deliverable <br />to the Subject Reach, the River District, with the <br />Service's concurrence, can substitute such water for <br />Wolford Mountain Reservoir Fish Pool water. <br /> <br />C. If and when the Service determines and notifies in <br />writing that water is no longer needed from Wolford <br />Mountain Reservoir Fish Pool for the recovery of listed <br />native fish species in the Subject Reach, the River <br />District's obligations under this MOU shall terminate and <br />the River District, in consultation with the Bureau of <br />Land Management, CWCB, and Colorado Division of Wildlife, <br />shall determine the priorities for the utilization of the <br />Fish Pool water. <br /> <br />VI.
